Johnson & Johnson asserts that bankruptcy is the only means to resolve both current and future lawsuits involving talc conclusively. That is, it thinks it will pay less if there is an element of bankruptcy that puts pressure for a settlement. Can talc cause lung cancer. Going back to more than 400 years in American history, the firm claims that bankruptcy benefits all parties as it distributes settlements more fairly and more efficiently than trial courts where litigants are awarded significant award while others do not.
The gist in the 3rd Circuit decision was this isn’t a case that involves one that makes a profit, but subsidiaries to meet the legal risk and declare bankruptcy Congress contemplated when drafting the Bankruptcy Code. But it also said that the subsidiary was not financially crisis because J&J promised unlimited funding.
Thus, J&J did not hesitate to take advantage of the unlimited funding portion of the contract and didn’t promise to provide unlimited funding for cases. The company claims that its revised financing arrangements with its subsidiary addresses the appeals court’s concerns, while offering funds to pay claims. It’s as if giving victims less money would solve the overall issue.
Attorneys representing cancer patients who oppose the deal counter this with what you conclude is countering legal nonsense with legal nonsense: J&J fraudulently transferred $50 billion of assets away from LTL Management to circumvent the appeals court’s decision. Hyperbole was not spared attorneys representing the victims claim it the largest “fraudulent move of assets in United States history.”
Notwithstanding the legal mumbo jumbo, J&J does not really think this bankruptcy will survive. It is however a method of pushing this $8.9 billion settlement and keep the pressure on plaintiffs.

J&J has now offered to pay $8.9 billion in settlements for all lawsuits.
The funders’ involvement is public information because of a New Jersey court rule requiring the release of certain details regarding outside funding backers. The rule aims to address the growing calls for the regulation of lawsuit funders. J&J has more than 60,000 claims when you combine federal and state baby powder lawsuits. However, there is no doubt that we are witnessing the ways that third-party funding can even the playing field for individuals and big companies in court.
