Johnson & Johnson asserts that bankruptcy is the only way to address both present and future lawsuits involving talc conclusively. Despite the legal jargon, J&J does not really think that the bankruptcy will endure. However, it’s a means to try and push the $8.9 billion settlement, and to keep pressure on plaintiffs.

April 10, 2023 Update: Bloomberg has an interesting article on a new law within New Jersey that is shedding new light on the funding of litigation in the baby powder plaintiffs in the class action.
