Johnson & Johnson asserts that bankruptcy is the only method to address both present and future talc litigations in a definitive manner. Also, it believes that it will be less expensive if there is a bankruptcy element that creates pressure to negotiate a settlement. Is baby powder still made with talc. Moving past 400 years of American history, the company claims that bankruptcy benefits all parties as it distributes settlement payments more equitably and more efficiently than trial courts which are where litigants get significant payouts, while others are left with nothing.

The main thrust in the 3rd Circuit decision was this is not a case of one that makes a profit, but an affiliate to accept the legal responsibility and declare bankruptcy – something Congress thought of when drafting its Bankruptcy Code. Lawyers representing cancer patients who do not agree with the agreement counter this with what you conclude is a defense against legal nonsense by pointing out legal nonsense: J&J fraudulently transferred $50 billion in assets to LTL Management to circumvent the appeals court’s ruling. Hyperbole was not spared the lawyers representing victims call it the largest “fraudulent transaction in United States history.”

Notwithstanding the legal mumbo jumbo, J&J does not really think that the bankruptcy will endure. It is however a method to try and push the $8.9 billion settlement through and maintain pressure on plaintiffs.

April 10 2023 Update Bloomberg offers an informative article on a new law of New Jersey that is shedding new light on the funding of litigation in the plaintiffs in the class action. Litigation funders Virage Capital Management and TRGP Capital invested in hundreds of claims in the case of Johnson & Johnson (J&J) regarding talc products, in exchange for a percentage of any profits. J&J has now offered that it will pay $8.9 billion to settle any lawsuits.

The involvement of the funders is public knowledge because of the New Jersey court rule requiring the release of certain details about funders outside the state. The rules aim to respond to the increasing calls for the regulation of lawsuit funders. J&J faces over 60,000 claims when you include federal and state baby powder lawsuits. Third-party funding for mass tort lawsuits is not without its pros and cons. But there is no question that we are witnessing the ways that third-party funding can even the playing field between individual and big corporations in court.
