Is makeup revolution’s talc safe. “The law firms that are behind the filing are pursuing financial interests which clash with, contradict and infringe on the rights of their clients. We’ll soon submit an answer before the court of appeals.”
Is makeup revolution’s talc safe. Clay Thompson, a lawyer for MRHFM which has more than 80 patients with mesothelioma who have filed lawsuits against J&J for bankruptcy, told J&J’s second bankruptcy attempt will fail.
“J&J publishes press release about how wonderful the plan is but simultaneously requesting that details of the plan, such as what the individual sick individuals would receive — be kept private,” Thompson said in an announcement. “What do J&J have to hide?”
Kaplan has instructed both sides to develop a new strategy for reorganization, under the supervision and supervision of mediators.
On February 20, 2022 Kaplan confirmed J&J’s use of Chapter 11 to hasten a settlement that would free J&J from the tens of thousands of claims over its talcum products.
However, in January of this year an appeals court of the federal government overturned the ruling, ruling that the company could not be considered to be in “financial financial distress.”
The J&J’s plan to contest the U.S. Supreme Court was dismissed at the end of April J&J filed for its second bankruptcy just two hours after. In response to that move, Kaplan froze the lawsuits for 60 calendar days to decide whether to allow the second bankruptcy.

Vara wrote that the bankruptcy courts are “open to honest, but naive debtors.” The doors “are not open to any parties who do not have a legitimate bankruptcy goal or who seek to take advantage of the bankruptcy process to delay or hinder their creditors.” Vara continued.
For its part, J&J maintains there is no definitive evidence to suggest that its Talc products, which includes its iconic baby powder, cause cancer. J&J has taken the products of the market, first in North America in 2020–and the rest of the world later this year.

He said that his team was notified by J&J in 1971 of the presence of asbestos chrysotile in the talc manufactured by the company, though with lesser than 0.1 percent. He also found more asbestos in 1976.
June 1st, 2023 Update: Is makeup revolution’s talc safe. This is the first court trial that has taken place since J&J made the decision to split its Talc division, and then declare bankrupt marks an important point of the ongoing litigation controversy. Trial started on Monday in the harrowing case of a young 24-year-old plaintiff, diagnosed with a rare and aggressive type of mesothelioma last year, a diagnosis lawyers on both sides acknowledge is a grave tragedy.
Opening statements laid bare sharp differences in the two sides’ story. The attorney for the plaintiff took aim at Johnson & Johnson, alleging the use of misleading methods in their research practices as well as throughout the litigation process. As per the lawyer, Johnson & Johnson attempted to alter the definition of asbestos in spite of internal documents from between 1978 and 1994 that showed asbestos fibers found in tissue of the plaintiff are included.
Johnson & Johnson’s uncertain $8.9 billion settlement proposal hangs in the balance as we progress of this trial. Despite the particularity of this mesothelioma case and its unique challenges compared to other lawsuits involving talcum powder, a verdict favoring the plaintiff could result in a serious setback to J&J’s hopes of broad acceptance of their proposed settlement among plaintiffs.
May 31st 2023 Update: Johnson & Johnson’s bankrupt talc business vigorously defended their two-time Chapter 11 filing in the face of challenges from talc injury claimants. In an opposition filed with the New Jersey bankruptcy court, it argued that the case differed fundamentally from the prior filing. It highlighted the extraordinary commitment to $8.9 billion by J&J the largest settlement ever in a mass tort bankruptcy case. Is makeup revolution’s talc safe. Not mentioned: how the magnitude of the settlement means it is a fair settlement. J&J also claimed support from several plaintiffs’ legal firms representing more than 60,000 claimants. This is hard to verify however it is likely to be incorrect.
May 24 2023 Update: As of Johnson &J Johnson’s bankruptcy filing, the first trial regarding the cosmetic talc products it claims to that contain asbestos is scheduled to commence jury selection on Monday in California within the Alameda County Superior Court, the most favored place for plaintiffs. The plaintiff claims his mesothelioma resulted from asbestos exposure in J&J’s product and that the company has denied. The trial also includes six retailers who are accused of selling talc-containing products.
May 22nd, 2023 Update: Lawyers involved in the 2nd J&J Talc bankruptcy are currently in a dispute over who should be chosen to fill the post of future claims representative. This is a role that is critically important to resolving the talc claims. Is makeup revolution’s talc safe. Randi Ellis, a lawyer who frequently appears in MDLs all over the nation was appointed the claims representative in the previous bankruptcy. J&J’s defense attorneys want Ellis to be appointed to that role yet again, but the lawyers for the plaintiffs in talc are arguing to the claim that Ellis has a conflict of interest that would prevent her from holding that position in the future. The issue stems from the reality that Ellis was involved in drafting the controversially litigated second bankruptcy, which raises concerns regarding her capacity to remain neutral. The reality is the bankruptcy will be dismissed in the end.
May 17th, 2023 Update: The pretend company that J&J made up to handle the bankruptcy of talc has informed the New Jersey bankruptcy court that they had allocated $400 million to pay the claims made by states accusing the company of deceptive advertising for its talc products. Is makeup revolution’s talc safe. That’s an $8.5 billion settlement for cancer patients. It’s hard to imagine any scenario in which J&J can get these baby powder settlements through at these numbers. While J&J’s $8.5 billion offer sounds like a huge sum initially, it does not appear appealing when you do the math. This settlement proposal – by our rough calculations, would not pay victims much more than $100,000 per instance. It’s not enough.
May 15, 2023 Update: J&J could be facing lawsuit from an advocacy group representing cancer patients. Is makeup revolution’s talc safe. The group argues that J&J deliberately retracted an $61.5 billion funding agreement together with its parent company, LTL Management LLC, to simulate financial distress and verify the unit’s Chapter 11 bankruptcy filing. The group argues that this act amounts to a fraudulent transfer of right to compensation for victims. They are planning to study J&J’s actions as a result of the dismissal of the first bankruptcy case of LTL.
May 10 2023 Update: During the next week in the U.S. Bankruptcy Court in New Jersey will hear oral arguments on a petition to dismiss the second bankruptcy application that was filed by J&J company LTL Management. In the meantime, this bankruptcy court has issued an order calling for both parties to take part in a settlement mediation hoping that a global settlement deal can reached.
May 5 2023: Update on Talc producer Whittaker, Clark & Daniels filed for Chapter 11 bankruptcy due to numerous lawsuits alleging its talc products cause cancer due to asbestos exposure. Is makeup revolution’s talc safe. Over 2,700 individuals have sued the firm and it is paying $1 million per month on legal defense. The company’s latest $29 million verdict on the state of South Carolina forced it to seek bankruptcy protection, arguing for equitable distribution of assets between talc claimants rather than being seized by the receiver. Other suppliers of talc have filed for bankruptcy due to legal proceedings.
May 4 2023 Update: U.S. Court of Bankruptcy Michael Kaplan has directed Johnson & Johnson to restart talks with lawyers who turned down the company’s proposed $8.9 billion settlement offer. At Trenton, New Jersey yesterday the parties gathered in court to discuss the next steps to take in the second bankruptcy case and Judge Kaplan encouraged further settlement talks.
This is the best way to resolve these claims for J&J. The baby powder settlement is likely to be completed. Is makeup revolution’s talc safe. But it’ll need more money, more billions of dollars – from Johnson & Johnson.
Lawyers are split on whether or not to accept the plan and not all clients view the issue in the same manner their lawyer sees it. This second case of bankruptcy is destined to go nowhere as Judge Kaplan has scheduled a hearing for June to determine if she will dismiss the bankruptcy for the second time.
May 3, 2023 Update The group of cancer patients suing Johnson & Johnson (J&J) asked that J&J’s Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it is an attempt to halt the litigation involving talc products. The committee representing talc claimants submitted a motion on Tuesday requesting the Third Circuit to consider their case and then send it back to a lower court, with instructions to discharge the bankruptcy. Is makeup revolution’s talc safe. They also requested that the stopped tort litigation against J&J continue to continue.
LTL has filed for Chapter 11 protection once again after its first bankruptcy filing was rejected by the Third Circuit earlier this year, offering the possibility of an $8.9 billion settlement. The committee says that the recent ruling which allowed LTL’s second Chapter 11 to continue, while also halting trials against J&J should be subject to urgent Third Circuit review. The US Trustee also requested that an New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s global vice-president of litigation, Erik Haas, was quoted by Bloomberg as saying that J&J intends to file a response to the appeals court characterizing the filing as a “desperate and legally flawed attempt” by a select group of law firms who have conflicting financial interests.
May 1 2023 Update: A common question that people ask is how could the plaintiffs’ lawyers and their clients turn around $8.9 billion. Of course, that is an enormous amount of money. But there are plenty of victims. Is makeup revolution’s talc safe. And these are really good arguments for plaintiffs. We were reminded of this last week in two talc trials which ended in large verdicts for plaintiffs. In February mesothelioma cases, a talcum powder trial in Oregon was settled with a verdict worth $18.1 million. In the same month, a different mesothelioma talc case was brought to trials on the other side of South Carolina and resulted in an award of $29 million in favor of plaintiff. In both instances, the defendant was Whittaker, Clark & Daniels Inc., one of the leading manufacturers of talc in U.S.
April 30, 2023 Update: When J&J initially attempted to pull the litigation over talcum powder into bankruptcy, they came with the option of putting aside $2 billion to settle the case. This was an absurdly low amount. There was no one among the talc victims who agreed with the proposal. This time, J&J has increased the offer to $8.9 for talc-related plaintiffs if they are willing to accept bankruptcy settlements and also has the support of a large part of the talc-related plaintiffs and their attorneys. Is makeup revolution’s talc safe. But with 75% of plaintiffs of talc are required to approve bankruptcy plans is not an easy task because of the number of lawyers who have massive stocks of baby powder litigations opposed in favor of the deal.
What could solve the impasse? More billions.
April 25 2023 Update Talc plaintiffs have sought a court order to dismiss their Chapter 11 case filed by LTL Management LLC, a absurdly-made-up Johnson & Johnson subsidiary, declaring that the company isn’t financially strained. LTL applied for Chapter 11 to settle tens of thousands of claims that J&J’s baby-powders caused cancer. Is makeup revolution’s talc safe. LTL was denied Chapter 11 in January. 3rd Circuit dismissed its first Chapter 11 case in January The court ruled that the company was not eligible for bankruptcy relief since it failed to show financial trouble.
The claimants argue that LTL’s second Chapter 11 case is an abuse of the bankruptcy system and it’s being conducted in bad faith. J&J asserts that the bankruptcy settlement receives “significant backing” from the firms that represent approximately 60,000 plaintiffs. It’s safe to say that lawyers representing plaintiffs and victims are divided over the $8.9 billion settlement offer.
April 21st, 2023 Update: A bankruptcy judge has ruled the company Johnson & Johnson must face new lawsuits claiming that the company sold tainted baby powder causing cancer. Even though trials for the lawsuits involving talc are delayed for at least 60 calendar days however, new lawsuits may be filed and lawyers can begin preparing their cases. Is makeup revolution’s talc safe. The judge expressed his doubts about J&J’s attempt to revive its strategy with the second bankruptcy case.
April 13 2023 update: the most important announcement is an $8.9 billion over the course of 25 years settlement offer. Lawyers representing cancer victims in MDL class action MDL class action have vowed to fight the settlement along with Talc claimants. Why? They feel it’s too little money for the 70 000 cancer patients. Is makeup revolution’s talc safe. The lawyers say that J&J should negotiate a larger settlement or pursue individuals’ claims if the current bankruptcy is thrown out.
But there is another group of lawyers outside of the leadership of that class action. They have amassed many thousands of cases. This group wants to settle now with what they believe is less than these victims deserve. Their argument seems to be twofold. First, they argue the settlement – about an average of $100,000 per plaintiff is fair.
This is an argument that is difficult to present. But their second argument has more teeth: victims can be no longer patient and demand their money now.
April 12 2023 Update: Some people are wondering if J&J is able to file for bankruptcy once more. The answer is complex and complicated. But let’s try to explain the issue in a simple way.
Johnson & Johnson asserts that bankruptcy is the only method to settle both present and future lawsuits involving talc conclusively. It believes it can pay less should there be a bankruptcy component that applies pressure to settle. Is makeup revolution’s talc safe. Moving past the 400-year span of American history, the firm believes that bankruptcy is beneficial to all parties because it distributes settlements more equally and effectively than trial courts which are where litigants get significant awards while others receive nothing.
The basic tenet of the 3rd Circuit decision was this is not a matter of a profitable company making subsidiaries to meet the legal liability and declare bankruptcy, which is what Congress contemplated when drafting the Bankruptcy Code. It also clarified the company was financially trouble because J&J promised unlimited funding.
Thus, J&J took advantage of the unlimited funding aspect of the holding and didn’t promise to provide unlimited funding for lawsuits. The company claims that its updated financing arrangements with its subsidiary address the appeals court’s concerns while still offering funds to pay claims. In the hope that offering victims less money will solve the underlying issue.
Attorneys representing cancer victims who do not agree with the agreement counter this with what you conclude is a defense against legal nonsense by pointing out legal nonsense: J&J fraudulently transferred $50 billion in assets away from LTL Management to circumvent the appeals court’s previous ruling. Hyperbole was not spared by the victims’ lawyers, who call it the biggest “fraudulent deal ever in United States history.”
Despite all the legal jargon, J&J does not really believe this bankruptcy will be able to last. It is however a method of trying to push this $8.9 billion settlement and keep pressure on plaintiffs.
April 10 2023 Update Bloomberg is running an intriguing article about a new law that has been passed in New Jersey that is shedding new light on the funding of litigation in the Class action suit. Funders for litigation Virage Capital Management and TRGP Capital invested in hundreds of claims against Johnson & Johnson (J&J) over talc products in exchange for a share of any winnings. J&J is now offering an offer of $8.9 billion to settle any lawsuits.
The funders’ involvement is made public because of an New Jersey court rule requiring the release of certain details regarding outside funding backers. The rule aims to respond to the increasing calls for regulation of the litigation funders. J&J has to deal with more than 60,000 lawsuits when you combine federal and state Baby Powder lawsuits. Third-party funding of mass tort cases has pros and pros and. However, there is no doubt that we are witnessing how third-party funding can level the playing field for individuals as well as large corporations in court.
April 4, 2023 Update: It is enjoyable to see the worm turning in this litigation. J&J was hit again this week when they were denied by the Third Circuit denied J&J’s request to maintain the automatic stay as J&J appeals an order granting bankruptcy at the U.S. Supreme Court. This automatic stay halted thousands of talcum cases and stopped new lawsuits from arising ever since J&J started the controversial process to spin the talc liabilities into a bankrupt entity over one year earlier. Is makeup revolution’s talc safe. After it was decided that the 3rd Circuit ruled that this bankruptcy was invalid some months ago, the stay was revoked. J&J wanted to see it stayed in place until its SCOTUS appeal. The answer was no.
April 1, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The chance the Supreme Court is willing even to take up the appeal? Low.
March 16, 2023 Update: with the bankruptcy stay having been officially lifted, the first new cases have been filed and transferred into the class action for talcum powder MDL within a year. Seven new talc lawsuits were joined to the MDL in the past month which brings the total number of cases that are pending to 37,522.
February 25, 2023 Update 2023 Update: A Congressmen from Tennessee is now requesting that the U.S. Government Accountability Office (GAO) initiate an investigation into how much J&J products containing talc have cost the government over the years.
In a recent letter to the GAO, Rep. Steven Cohen (D-Ten.) has accused J&J of ignoring the risks of its talc products over years while tax dollars were spent treating those injured by exposure to the products. The demand comes just weeks after J&J’s loss to the 3rd Circuit Court of Appeals.
Is makeup revolution’s talc safe. J&J needs to start making reasonable settlements to victims to to put all of this behind it. This is a blemish on one of the world’s greatest businesses.
February 14 2023 Update: In the hearing held today at the hearing in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention to follow the third U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
