The company is trying for a second time to resolve more than 38,000 lawsuits filed in bankruptcy, and to prevent any new cases from being filed in the future.
LTL’s bankruptcy plan would pay $400 million to an additional trust to settle lawsuits filed with state attorneys general alleging that J&J had violated the state’s unfair commercial practices as well as consumer protection laws through misleading consumers about the quality of its talc products.

Some states had started consumer protection cases against J&J before LTL’s first bankruptcy filing prevented these investigations from progressing in 2021. Is talc cancer causing. New Mexico and Mississippi had already brought actions in the past against Johnson & Johnson before then and the states of Arizona, Maryland, North Carolina, Texas and Washington had issued civil investigative subpoenas or demands, according to LTL’s court papers.

New Mexico and Mississippi have filed a petition to end LTL’s bankruptcy along with cancer sufferers and their counterparts from the U.S. Justice Department’s bankruptcy watchdog. argue that a profit-making company such as J&J cannot benefit from bankruptcy protections designed for struggling debtors.
The first attempt by LTL to resolve the bankruptcy lawsuits was rejected after the same arguments, when a U.S. appeals court ruled that LTL did not have “financial difficulty” and thus not eligible to receive bankruptcy relief. Is talc cancer causing. LTL made a new bankruptcy application in just two hours following the dismissal, saying that its second attempt was different as it had less money available and more backing for an agreement.

New Mexico and Mississippi said in their motion for dismissal that LTL’s bankruptcy renewal violates state law enforcement powers by seeking to unilaterally limit the company’s liability for state consumer protection actions.

LTL’s filings for the new year also contained more information on the way in which the company will evaluate and pay for cancer claims if the bankruptcy plan is approved.

The highest payments under the settlement would be $500,000 for people diagnosed with mesothelioma terminal prior to age 45, and $260,000 for those who have been diagnosed with ovarian cancer that is terminal before age 45.

The proposed settlement offers discounts based on the kind and severity of cancer, an individual’s age, history of using talc and other factors. Is talc cancer causing. For instance someone who regularly used talc products on a weekly basis, who had the family history of ovarian cancer and was diagnosed with stage II ovarian cancer at the age of 55 may be eligible for a $21,125 payment according to the plan.

Judge decides J&J and talc opponents to participate in settlement talks.

Following another hearing in Johnson and Johnson’s efforts to implement a Texas Two-Step bankruptcy strategy to resolve talc litigation, federal bankruptcy Judge Michael Kaplan has ordered the company as well as those who oppose the plan to enter into talks to reach a settlement, Bloomberg reports.

In its second bankruptcy effort for LTL Management–a subsidiary established by J&J to settle claims – the company made a settlement offer of $8.9 billion. Is talc cancer causing. While one firm representing plaintiffs is in favor of the offer, another group is opposed to the offer.

The previous week, the opposition group, dubbed”The Official Committee of Talc Claimants requested the bankruptcy court for dismissal of the matter argument that LTL is not considered to be in financial hardship.

“The filing is a desperate and legally ineffective attempt by a handful of law firms to stop claimants from deciding on the resolution plan – a plan the vast and growing majority of claimants favor,” J&J’s litigation chief Erik Haas, said in an announcement. Is talc cancer causing. “The law firms involved in these filings have interests in finance that are in conflict with, diverge from, and oppose the interests which their clientele. We’ll submit an answer to the appellate court.”

Is talc cancer causing. Clay Thompson, a lawyer for MRHFM which includes more than mesothelioma patients who have sued J&J, said that J&J’s second bankruptcy effort failed.

“J&J sends out press releases about how wonderful the plan is but simultaneously insisting that the plan’s details, including what individual sick people would actually receive,” Thompson said in an announcement. “What is J&J’s plan to conceal?”

Kaplan has instructed both sides to develop a new strategy for reorganization, under the supervision by two mediators.

As of February 2022 Kaplan stated that J&J’s recourse to Chapter 11 to hasten a settlement that will free the company from the hundreds of thousands of claims regarding its talcum products.

In January of this year an appeals court of the federal government overturned the decision, ruling that the firm could not be considered to be in “financial distress.”

The J&J’s plan to make an appeal before the U.S. Supreme Court was dismissed the same month, J&J was granted a second petition for bankruptcy two hours after. In response to that move, Kaplan froze the lawsuits for 60 days to decide whether or not to accept an additional bankruptcy.

J&J’s unstoppable profit machine sputters after $6.9B cost of litigation involving talc.

With the two Chapter 11 attempts, J&J has bought 19 months during which cases were placed held. Is talc cancer causing. The company would like claimants to take a vote to accept their settlement. J&J needs 75% of the vote in order for the agreement to be accepted.

In addition to the group of talc attorneys who have panned the company’s bankruptcy play, the U.S. Trustee is an arm from the U.S. Department of Justice was also the one to file a motion to dismiss LTL’s second bankruptcy.

In a recent filing, U.S. Trustee Andrew R. Vara wrote that the doors of bankruptcy are “open to honest, but naive debtors.” Those doors “are not open to any parties who do not have a legitimate bankruptcy goal or who seek to use the bankruptcy process to hinder or delay their creditors.” Vara continued.

To its credit, J&J maintains there is no definitive evidence to suggest that its talc products, including its famous baby powder, cause cancer. J&J has adopted the products of the market first for North America in 2020–and the rest of the world later this year.

J&J intends to steer clear of the cost of going to trial. J&J has won the majority of the cases that have been resolved during trial, however, some losses have been very punitive.
A high-profile trial in Missouri produced a $4.7 billion verdict against the drug maker that was later reduced to $2.1 billion following appeals.

Johnson & Johnson faces high-stakes hearing over ‘Texas Two Step’ talc strategy: report
In all, J&J has lost nine trial involving talc that are in appeal or settled. Out of 41 trials 32 have resulted in the favor of J&J as well as mistrials or verdict of a plaintiff annulled after appeal. Is talc cancer causing. Separately, the company in 2020 negotiated to settle more than 1000 cases at a cost of $110 million. Bloomberg reported at the time.

Johnson and Johnson Talcum Powder Lawsuit Update 2023 – Is Talc Cancer Causing

June 2 2023 Update: In the trial for asbestos-containing talc at the trial in California yesterday, a few technical issues halted the opening statement by the defense attorneys. Is talc cancer causing. Jurors watching from home via Zoom and hearing the Johnson & Johnson’s lawyer voice his doubt about the science of the 70s asserting the presence of asbestos in their product prior to the proceedings abruptly ended.

In the meantime, the plaintiff could present an initial witness Arthur Langer. Langer said that the presence of other minerals in the talc’s mineral content is inevitable. He testified that his team informed J&J in 1971 of the presence of chrysotile asbestos in the talc of the company, but in less than 0.1 percent. He also discovered more asbestos in 1976.

June 1st, 2023 Update: Is talc cancer causing. The first trial since J&J made the decision to split its talc segment and file for bankruptcy is an important moment of the ongoing lawsuit drama. Trial began yesterday in the tragic trial of a young plaintiff, diagnosed with a rare and aggressive type of mesothelioma in the past year, an illness that lawyers on both sides acknowledge is a tragic loss.

The opening statements exposed the huge differences between the sides’ narrative. The plaintiff’s attorney took aim at Johnson & Johnson, alleging the use of deceitful methods in their research practices as well as throughout the litigation process. The attorney claims that, according to Johnson & Johnson attempted to alter the definition of asbestos, despite internal documents from 1978 and 1994 showing that fibers discovered in the tissue of the plaintiffs are included.

Johnson & Johnson’s precarious $8.9 billion settlement offer hangs in the balance as we progression of this trial. Despite the distinctive nature of this mesothelioma-related case and its distinctive issues in comparison to other talcum powder lawsuits and a decision in favor of the plaintiff could inflict a serious setback to J&J’s hopes of broad acceptance of their proposed settlement among plaintiffs.

May 31 2023 Update: Johnson and Johnson’s bankrupt talc division was able to defend its 2nd Chapter 11 filing in the in the face of challenges from victims of talc injuries. In an appeal to the New Jersey bankruptcy court, it argued that the case was fundamentally different from the previous filing. It also emphasized the unprecedented commitment to $8.9 billion from J&J which is the biggest settlement ever to be made in a mass tort bankruptcy case. Is talc cancer causing. It was not mentioned how the amount of the settlement indicates that it is a fair settlement. J&J also claimed that it received support from a variety of plaintiffs’ law firms that represent over 600,00 claimants. This is hard to verify however it is likely to be incorrect.

May 24 2023 Update: As of Johnson & Johnson’s bankruptcy in 2021 filing, the first trial involving its cosmetic talc products allegedly containing asbestos is set to start jury selection on Monday, May 24, California at Alameda County Superior Court, which is a well-known court for plaintiffs. The plaintiff claims that his mesothelioma was triggered by asbestos exposure through J&J’s products which the company has denied. The trial also involves six retailers accused of selling talc products.

May 22, 2023 Update: Lawyers involved in the second J&J Talc bankruptcy are currently in a dispute over who should be appointed to the role of future claims representative. This is an important role critical to resolving Talc claims. Is talc cancer causing. Randi Ellis, a lawyer who regularly appears in MDLs throughout the country was appointed the claims representative during the first bankruptcy. J&J’s defense attorneys want Ellis to be appointed to this position and again, but attorneys for the talc plaintiffs have raised objections on the grounds that Ellis has conflicts of interest that would prevent her from holding that position again. The dispute stems from possibility that Ellis was apparently involved in drafting the controversially contesting second bankruptcy, which raises concerns regarding her capacity to remain neutral. In reality, this bankruptcy will likely to be dismissed in the end.

May 17, 2023 Update The pretend company J&J made up for the talc litigation bankruptcy disclosed to a New Jersey bankruptcy court that they have set aside $400 million to pay the claims made by states accusing the company of misleading advertising regarding its talc products. Is talc cancer causing. This amounts to an $8.5 billion settlement for cancer sufferers. It’s difficult to envision an eventuality where J&J could push the settlements of baby powder through with these numbers. While J&J’s $8.5 billion offer sounds like a lot of money at first, it does not look very appealing after you calculate the figures. This settlement proposal – by our rough calculations would not pay victims much more than an average settlement $100,000 per case. That is not enough.

May 15th 2023 update: J&J is potentially facing a suit from an advocacy group representing cancer patients. Is talc cancer causing. The group claims that J&J deliberately withdrew the $61.5 billion fund-raising agreement together with its parent company, LTL Management LLC, to simulate financial stress and validate the unit’s Chapter 11 bankruptcy filing. The group argues that this act amounts to a fraudulent transfer of rights of compensation for victims. They will investigate J&J’s actions as a result of the denial of the LTL’s bankruptcy case in its first instance.

May 10 2023 Update: The following week in it is expected that the U.S. Bankruptcy Court in New Jersey will hear oral arguments in a motion dismiss the second bankruptcy application of J&J subsidiary LTL Management. In the meantime this bankruptcy court has issued an Order which requires both sides to participate in a second settlement mediation with the hopes of achieving it will be possible to reach a global settlement agreement brokered.

May 5, 2023: Update on Talc producer Whittaker, Clark & Daniels filed for Chapter 11 bankruptcy due to many lawsuits claiming that its talc products cause cancer from asbestos exposure. Is talc cancer causing. More than 2700 people have filed lawsuits against the company and it is paying $1 million per month to defend its legal position. The company’s recent $29million verdict that was handed down in South Carolina forced it to pursue bankruptcy protection, and arguing for an equitable distribution of assets among talc claimants instead of being taken from the receiver. Other suppliers of talc have been forced to file for bankruptcy as a result of legal proceedings.

May 4 2023, Update U.S. Bankruptcy Judge Michael Kaplan has directed Johnson & Johnson to relaunch talks on settlement with lawyers who rejected the company’s $8.9 billion deal. It was in Trenton, New Jersey yesterday, the parties appeared in court to discuss next steps in their second bankruptcy matter. Judge Kaplan pushed more settlement talks.

This is the way to resolve the claims of J&J. A settlement for baby powder can be made. Is talc cancer causing. But it will require more money – billions of dollars by Johnson & Johnson.

Lawyers are divided on whether to accept the proposal and not all clients view this issue the same way their lawyer sees it. Second bankruptcy cases are expected to fail, with Judge Kaplan has scheduled a hearing for June to determine if she will discharge the bankruptcy for the 2nd time.

May 3 2023 Update: A group of cancer patients who have sued Johnson & Johnson (J&J) demanded an order from J&J’s Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it is a bid to stop the litigation involving talc products. The group representing the claimants made a motion Tuesday requesting to the Third Circuit to consider their case and then send it back an earlier court with instructions to dismiss the bankruptcy. Is talc cancer causing. They also requested that the lawsuit against the halted torts of J&J continue to continue.
LTL has filed for Chapter 11 protection once again after its bankruptcy filing was denied in the Third Circuit earlier this year, offering an $8.9 billion payment. The committee argues that the recent decision allowing the second Chapter 11 to continue, and also stopping trials against J&J, warrants the immediate Third Circuit review. The US Trustee has also requested it be requested that the New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s vice president for global litigation Erik Haas, was quoted by Bloomberg declaring that J&J intends to file a formal response in the appeals court, characterizing the filing as a “desperate and legally flawed move” by a few of law firms that have conflicting financial interests.
May 1 2023 Update: A frequently asked question is how plaintiffs and their lawyers turn down $8.9 billion. That’s of course an enormous amount of money. There are a lot of victims. Is talc cancer causing. These are an excellent case for plaintiffs. We have been reminded of this recently by two talc-related trials that led to huge verdicts for the plaintiffs. In February, a talcum powder mesothelioma trial in Oregon resulted in an award that was $18.1 million. A month later, another mesothelioma talc case was brought to trials within South Carolina and resulted in an award of $29 million in favor of plaintiff. It was the same defendant as in these cases: Whittaker, Clark & Daniels Inc. which is one of the leading suppliers of talc in the U.S.
April 30 2023 Update: In the year 2023, when J&J initially attempted to pull the talcum powder litigation into bankruptcy, they came with an offer to set aside $2 billion to settle the case. This was an absurdly low amount. There was no one among the talc victims who believed in it. However, this time, J&J has increased the offer to $8.9 If the talc plaintiffs accept a bankruptcy settlement and they have the support of a substantial portion of the talc plaintiffs and their lawyers. Is talc cancer causing. But with 75% of plaintiffs of talc are required to approve bankruptcy plans is not an easy task because of the number of lawyers who have huge stocks of baby powder litigations opposed to the settlement.

What are the solutions to the impasse? More billions.
April 25 2023, Update Talc patients have sought a court order to reject the Chapter 11 case filed by LTL Management LLC, a absurdly fabricated Johnson & Johnson subsidiary, insisting that the company is not financially distressed. LTL has filed for Chapter 11 to settle tens of thousands of claims that J&J’s baby powders cause cancer. Is talc cancer causing. In the end, however, the 3rd Circuit dismissed its first Chapter 11 case in January, saying the company wasn’t eligible to receive bankruptcy relief because it failed to show financial trouble.

The claimants argue that the third Chapter 11 case is an misuse of the bankruptcy system and that the case is being handled in bad good faith. J&J claims the bankruptcy settlement is backed by “significant backing” from firms representing an estimated 60,000 plaintiffs. It’s safe to say that lawyers representing plaintiffs and victims ‘ lawyers are not united over this $8.9 billion deal.

April 21st, 2023 Update A bankruptcy judge has ruled that Johnson & Johnson must face new lawsuits alleging that the company sold tainted baby powder causing cancer. Although trials for the lawsuits involving talc are delayed for a minimum period of 60 days however, new lawsuits may be filed, and lawyers may begin to prepare their cases. Is talc cancer causing. The judge expressed his doubts about J&J’s absurd attempt to relaunch its strategy in the second bankruptcy case.

April 13, 2023: Update on the biggest announcement is an $8.9 billion over 25 years of settlement. Lawyers representing cancer patients within MDL class action MDL group action pledged to fight the settlement with talc claimants. Why? They believe it’s not enough to pay for more than 70,000 cancer victims. Is talc cancer causing. These lawyers believe that J&J should negotiate a bigger settlement or settle individuals’ claims if the current bankruptcy is declared unconstitutional.

But there is another group of lawyers that is not part of the leadership in that class action. They have amassed the equivalent of tens of thousands of lawsuits. The group is seeking to settle today for what is believed to be far less than what these victims deserve. Their argument is two-fold. First, they argue the settlement of around 100,000 dollars per plaintiff – is fair.

That is a hard argument to present. The second argument is more force: victims should not afford to wait any longer and need the money immediately.

April 12 2023 Update: People are wondering if J&J can go through bankruptcy again. The answer is complicated and confusing. Let’s try to clarify the issue in a simple way.
Johnson & Johnson asserts that bankruptcy is the only means to address both present and future lawsuits involving talc conclusively. It thinks it will pay less in the event of the bankruptcy element which applies pressure to negotiate a settlement. Is talc cancer causing. Going back to the 400-year span of American history, the company claims that bankruptcy benefits all parties because it distributes settlement payments more evenly and efficiently than trial courts, in which some litigants receive substantial awards while others receive nothing.

The gist of this 3rd Circuit decision was this isn’t a case that involves the profit-making company that has an entity to assume the legal risk and declare bankruptcy – something Congress considered when it was drafting the Bankruptcy Code. It also clarified that the subsidiary was not financially difficulty because J&J promised unlimited funding.
Then J&J jumped on the unlimited funding aspect of the contract but did not pledge to provide unlimited funding for cases. The company says that its revised financing arrangements with its subsidiary will address appeals court’s concerns while still providing funds for claims. As if offering victims less money would solve the underlying issue.

Attorneys representing cancer victims who oppose the deal counter this by arguing that the plaintiff is countering legal nonsense with legal absurdity: J&J fraudulently transferred $50 billion of assets away from LTL Management to circumvent the appeals court’s ruling. Hyperbole was not spared by the victims’ lawyers, who call it the largest “fraudulent transaction that has occurred in United States history.”

Despite the legal jargon, J&J does not really think this bankruptcy will survive. But it’s a way of pushing this $8.9 billion settlement, and to keep pressure on plaintiffs.

April 10 2023 Update: Bloomberg offers an informative report on a brand new law that has been passed in New Jersey that is shedding new light on the funding of litigation in the class action lawsuit. Funders of litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits against Johnson & Johnson (J&J) over talc products in exchange for a portion of any winnings. J&J is now offering that it will pay $8.9 billion to settle all lawsuits.

The funders’ involvement is public information because of an New Jersey court rule requiring the release of certain details about funding sources outside of the. This rule is intended to tackle the growing demands for regulation of the litigation funders. J&J has more than 60,000 claims when you combine state and federal Baby Powder lawsuits. Third-party funding of mass tort cases has both pros and cons. But there is no question that we are seeing how third-party financing can help level the playing field between individual and big companies in the courtroom.

April 4, 2023 Update: It is pleasing to see the worm turn in this lawsuit. J&J took another hit this week, when the Third Circuit denied J&J’s request to continue the automatic stay during the time that J&J appeals a bankruptcy ruling before the U.S. Supreme Court. Automatic stays have halted thousands of talcum powder cases and stopped new lawsuits from getting filed ever since J&J launched the controversial attempt to spin the talc debts into a bankrupt subsidiary more than one year ago. Is talc cancer causing. When the 3rd Circuit ruled that this bankruptcy was invalid some months ago, the stay was lifted. J&J was hoping to have it stayed in place until its SCOTUS appeal. But the answer was no.
April 1, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The chance of the Supreme Court is willing even to accept the appeal? Low.
March 16th 2023 Update: With the bankruptcy stay having been fully lifted, the first new cases have been filed and transferred into the class action for talcum powder MDL in the space of a year. Seven new talc-related lawsuits were joined to the MDL in the past month increasing the number of cases pending to 37,522.

February 25, 2023 Update: A Congressmen from Tennessee has now demanded that be the U.S. Government Accountability Office (GAO) launch an investigation into how much J&J product containing talc has cost the government over the years.
in a letter addressed to the GAO, Rep. Steven Cohen (D-Ten.) has accused J&J of failing to recognize the dangers of its talc products over decades while tax dollars were spent treating those injured by exposure to the chemicals. This lawsuit comes a few weeks after J&J’s major loss in the 3rd Circuit Court of Appeals.

Is talc cancer causing. J&J should begin to make reasonable settlements to victims to in putting this behind it. It is a stain on one of the greatest firms.

February 14 , 2023 Update: At a hearing today in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention in light of the ruling of 3rd U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
