LTL has filed for Chapter 11 protection once again following its bankruptcy filing that was denied by the Third Circuit earlier this year with the possibility of an $8.9 billion settlement. April 13 2023 Update: big news is the $8.9 billion over 25 year period settlement offered. Lawyers representing cancer patients who are part of MDL class action MDL group action promised to fight the settlement alongside those who claim talc. Why? The lawyers say that J&J should negotiate a bigger settlement or settle individuals’ claims if the current bankruptcy is declared unconstitutional.

There is a different group of lawyers outside of the leadership in group action. The lawyers collectively have accumulated hundreds of thousands of cases. The group is seeking to settle today with what they believe is lower than what the victims should be paid. Their argument is twofold. First, they argue the settlement, which is about the equivalent of $100,000 per plaintiff is fair.

That is a hard argument to prove. However, their second argument has more teeth: victims can no longer wait and want their money now.

April 12 2023 Update: Many are looking for ways J&J is able to file for bankruptcy again. The answer is complicated and complicated. Let’s try to simplify it clearly.

J&J is now offering to pay $8.9 billion in settlements for all lawsuits.

The funders’ involvement is public information because of an New Jersey court rule requiring the release of certain details regarding outside funding backers. The law is designed to respond to the increasing calls for regulation of the litigation funders. J&J is facing more than 60,000 claims when you combine state and federal baby powder lawsuits.
