April 13th, 2023 Update: The major announcement is an $8.9 billion over the course of 25 years settlement offer. Johnson & Johnson asserts that bankruptcy is the only way to resolve both current and future talc-related lawsuits definitively. It thinks it will pay less when there is an element of bankruptcy that puts pressure for a settlement. Is talc safe to eat. Moving past the 400-year span of American history, the firm asserts that bankruptcy benefits all parties because it distributes settlement payments more evenly and effectively than trial courts which are where litigants get significant settlements while others get nothing.

Funders of litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits against Johnson & Johnson (J&J) regarding talc products, in exchange in exchange for a portion of settlements. J&J is now willing that it will pay $8.9 billion to settle lawsuits.

The involvement of funders is public information because of an New Jersey court rule requiring the release of certain details regarding outside funding backers. This rule is intended to address the growing calls for regulation of litigation funders. J&J is facing more than 60,000 claims when you take into account federal and state infant powder litigation. Third-party funding in mass tort claims has its pros and cons. There is no doubt that we are witnessing how third-party funding could level the playing field between individual and large corporations in court.
