New Mexico and Mississippi have taken steps to halt the bankruptcy of LTL along with cancer sufferers and the U.S. Justice Department’s watchdog on bankruptcy, who have claimed that a lucrative company such as J&J cannot benefit from bankruptcy protections aimed at the struggling debtors.
The first time LTL attempted to settle the lawsuits in bankruptcy was dismissed after similar arguments. A U.S. appeals court ruled it was not LTL did not have “financial financial distress” and thus not eligible of bankruptcy protection. Is there a link between talc and cancer. LTL filed a second bankruptcy just over two hours after that dismissal, arguing that the second bankruptcy was different because it had less money and more support for a settlement.

New Mexico and Mississippi said in their motion to dismiss LTL’s bankruptcy renewal violates state law enforcement powers by attempting unilaterally to cap the liability of the company for state consumer protection actions.

LTL’s filings for the new year also contained more information on how the company would evaluate and settle cancer claims in the event that the bankruptcy plan is approved.

The highest payments under the settlement would be $500,000 for people diagnosed with mesothelioma terminal prior to age 45, and $260,000 for patients diagnosed with terminal ovarian cancer before age 45.

From there, the proposed settlement will offer discounts based on the kind and severity of cancer, the patient’s age, the history of talc use and other factors. For example someone who regularly used daily talc products, had a family history of ovarian cancer, and was diagnosed with an ovarian cancer stage II when she was 55 might qualify to receive a payment of $21,125 under the program.

Judge ordains J&J and talc opponents engage in settlement talks.

Following another hearing in Johnson & Johnson’s effort to use a Texas Two-Step bankruptcy strategy to settle talc lawsuits, federal bankruptcy Judge Michael Kaplan has ordered the firm and the people who opposed the plan to hold settlement talks, Bloomberg reports.

With its second bankruptcy bid for LTL management, a subsidiary founded by J&J to settle claims – the company made a settlement offer of $8.9 billion. Is there a link between talc and cancer. While one firm representing plaintiffs agree with the deal, another group opposes the deal.

Earlier this week, the opposition group, called”the Official Committee of Talc Claimants and urging the bankruptcy court for dismissal of the matter by arguing that LTL can not be considered financially distressed.

“The filing is a desperate and legally ineffective attempt by a tiny number of law firms to stop claimants from voting on the resolution plan – a plan that the overwhelming majority of claimants favor,” J&J’s litigation chief Erik Haas, said in a statement. Is there a link between talc and cancer. “The law firms who filed these filings have interests in finance that do not align with, diverge from, and infringe on the rights which their clientele. We’ll be submitting an appeal an appeal to the appellate court.”

Is there a link between talc and cancer. Clay Thompson, a lawyer for MRHFM who is home to more than mesothelioma victims who have sued J&J, said that J&J’s second bankruptcy attempt will fail.

“J&J issue press releases that boast about how amazing the plan is but simultaneously requesting that details of the plan, such as what individuals with illnesses would receive — be kept private,” Thompson said in an email. “What do they have to keep secret?”

Kaplan has instructed the sides to come up with another arrangement plan under the oversight and supervision of mediators.

In February 2022, Kaplan stated that J&J’s use of Chapter 11 to hasten a settlement that would release the company from the thousands of lawsuits over its talcum products.

However, in January of this year a federal appeals court overturned the ruling, ruling that the business could not be considered in “financial distress.”

The J&J’s plan to make an appeal before the U.S. Supreme Court was turned down in April, J&J applied for its first bankruptcy about two hours after. In response to that move, Kaplan froze the lawsuits for 60 days in order to determine whether or not to accept to file for bankruptcy again.

J&J’s unstoppable profit machine sputters after $6.9B talc litigation charge.

With two Chapter 11 attempts, J&J has purchased 19 months of which cases were put suspended. Is there a link between talc and cancer. J&J wants the claimants to vote on accepting their settlement. J&J requires 75% of the vote for the deal to go through.

In addition to the group of talc lawyers that criticized the company’s bankruptcy in the U.S. Trustee, the U.S. Trustee, an arm belonging to the U.S. Department of Justice, also filed an application to dismiss the second bankruptcy case of LTL.

In a statement this week, U.S. trustee Andrew R. Vara wrote that the the bankruptcy court are “open to honest but unfortunate debtors.” The doors “are not open to parties that do not have a legitimate goal or who seek to abuse the bankruptcy process to hinder or delay their creditors,” Vara continued.

In its own words, J&J maintains there is no conclusive evidence that its talc products, including the famous baby powder, cause cancer. J&J has taken the products of the market, first in North America in 2020–and the rest of the world this year.

J&J seeks to avoid the cost of going to trial. J&J has won most of the cases that have been decided through trial, though certain losses have been extremely severe.
A highly-publicized trial in Missouri led to a $4.7 billion verdict against the drugmaker but was later reduced to $2.1 billion after appeals.

Johnson & Johnson faces high-stakes hearing over ‘Texas Two Step’ talc strategy: report
In all, J&J has lost nine cases involving talc, which are being appealed or concluded. Out of 41 trials 32 of them ended in a win by J&J as well as mistrials or verdict of a plaintiff reversed after appeal. Is there a link between talc and cancer. In addition, J&J has announced plans to settle more than 1,000 cases worth $110 million. Bloomberg published at the time.

Johnson and Johnson Talcum Powder Lawsuit Update 2023 – Is There A Link Between Talc And Cancer

June 2 2023 Update: In the asbestos talc trial that took place in California yesterday, technical glitches interrupted the opening statements of the defense attorneys. Is there a link between talc and cancer. Jurors watching from home on Zoom, did hear Johnson & Johnson’s lawyer expressing skepticism about the 70s science asserting the presence of asbestos in their product prior to the session abruptly ended.

In the meantime, the plaintiff was able to present their first witness, Arthur Langer. Langer explained that the occurrence of other minerals with talc is inevitable. He also testified that his team advised J&J in 1971 of the presence of asbestos chrysotile in the talc manufactured by the company, though with less than 0.1 percent. The asbestos was discovered by him in 1976.

June 1, 2023 Update: Is there a link between talc and cancer. The first trial since J&J decided to spin off its talc segment and file for bankruptcy marks an important moment in the ongoing talc litigation story. The trial started yesterday in the poignant trial of a young plaintiff, diagnosed with a rare and aggressive form of mesothelioma last year, which lawyers on both sides acknowledge is a grave tragedy.

The opening statements exposed the huge differences between the sides’ story. The attorney representing the plaintiff aimed his ire on Johnson & Johnson, alleging that the company employed deceitful methods in their research practices as well as throughout the litigation procedure. According to the attorney the company tried to manipulate asbestos’ definition, in spite of internal documents from 1998 and 1994 that show asbestos fibers that were found in the tissues of the plaintiff are part of.

Johnson & Johnson’s uncertain $8.9 billion settlement is hanging in the balance with the progression of this trial. Despite the particularity of this mesothelioma case and the unique issues it faces compared to other talcum powder lawsuits A verdict in favor of the plaintiff could cause an unintended setback to Johnson & J’s expectations of widespread acceptance of their settlement proposal among plaintiffs.

May 31, 2023: Update from Johnson and Johnson’s bankrupt talc unit is defending their 2nd Chapter 11 filing in the in the face of challenges from victims of talc injuries. In a written objection to the New Jersey bankruptcy court, the company argued that the situation was distinct from the first filing. The subsidiary emphasized the record-breaking commitment to $8.9 billion from J&J, the biggest settlement ever to be made in an bankruptcy case involving mass torts. Is there a link between talc and cancer. There was no mention of how the size of the settlement implies that it is an equitable settlement. J&J also claimed that it received support from several plaintiffs’ legal companies representing over sixty thousand claimants. This is not easy to confirm however it is likely to be incorrect.

May 24 2023 Update: As of Johnson & Johnson’s bankruptcy in 2021 filing, the first trial concerning its cosmetic talc products that are believed to comprised of asbestos is set to begin jury selection on Monday in California with Alameda County Superior Court, an historically reliable court for plaintiffs. Plaintiff claims that mesothelioma is the result of asbestos exposure in J&J’s product and the company denies. The trial also includes six retailers accused of selling talc-containing products.

May 22nd, 2023 Update Lawyers involved in the second J&J talc bankruptcy are disputing who should be appointed to the role of the claims representative in the future, which is vitally essential to the resolution of the claims involving talc. Is there a link between talc and cancer. Randi Ellis, a lawyer who frequently appears in MDLs throughout the United States was appointed the claims representative in the first bankruptcy. J&J’s defense team would like Ellis to be appointed to that role again, but lawyers for the talc plaintiffs have raised objections to the claim that Ellis has a conflict of interest which would prohibit her from taking on that role again. The issue stems from the issue that Ellis was believed to have been involved in drafting the controversially contested second bankruptcy, raising doubts about her capacity to be neutral. In reality, this bankruptcy is likely to get dismissed anyway.

May 17, 2023 Update The fake company J&J made up for the talc litigation bankruptcy told a New Jersey bankruptcy court that they have set aside $400 million to settle claims of states that accuse J&J of misleading marketing for its talc product. Is there a link between talc and cancer. It’s a $8.5 billion settlement for cancer victims. It’s difficult to imagine a scenario where J&J could push the settlements of baby powder through in these figures. While J&J’s $8.5 billion offer seems like a large sum initially, it does not look very appealing when you look at the numbers. The settlement plan based on our rough calculations, would not be able to pay victims more than $100,000 per instance. That’s not enough.

May 15, 2023, Update J&J might be facing lawsuit by an advocacy group representing cancer victims. Is there a link between talc and cancer. The group claims that J&J deliberately retracted an $61.5 billion contract for funding that it had with its company subsidiary LTL Management LLC, to create the appearance of financial hardship and validate the unit’s Chapter 11 bankruptcy filing. The group asserts this action is a fraud transfer of the rights of compensation for victims. They are planning to study J&J’s actions after the announcement of the denial of LTL’s first bankruptcy case.

May 10 2023 Update: Next week next week, next week, the U.S. Bankruptcy Court in New Jersey will hear oral arguments regarding a motion to dismiss the second bankruptcy filing from J&J subsidiary LTL Management. In the meantime, however, the bankruptcy has issued an Order requiring both sides to participate in a new settlement negotiation hoping that the global settlement can be reached.

May 5th 2023: Update on Talc manufacturer Whittaker, Clark & Daniels filed for Chapter 11 bankruptcy due to numerous lawsuits alleging its talc products caused cancer through asbestos exposure. Is there a link between talc and cancer. Over 2700 people have sued the firm and it is paying $1 million per month to defend itself. The company’s latest $29 million verdict at the Supreme Court of South Carolina forced it to pursue bankruptcy protection, and arguing that assets should be distributed in an equitable manner among talc claimants instead of being taken by the receiver. Other suppliers of talc have filed for bankruptcy due to the litigation.

May 4, 2023 Update U.S. Bankruptcy Judge Michael Kaplan has directed Johnson & Johnson to restart talks with lawyers who have rejected Johnson & Johnson’s $8.9 billion deal. The court in Trenton, New Jersey yesterday the parties appeared in court to discuss next steps for the second bankruptcy case. Judge Kaplan was pushing for more settlement discussions.

This is the answer to settle these claims with J&J. A baby powder settlement could get done. Is there a link between talc and cancer. However, it will require more money, more billions of dollars – by Johnson & Johnson.

Lawyers are divided on whether to take the proposal or not and not all clients view the issue the same way their lawyer does. This second case of bankruptcy is bound to be a failure as Judge Kaplan has scheduled a hearing in June to determine whether to dismiss the bankruptcy for the second time.

May 3 2023 Update A group of cancer victims who are suing Johnson & Johnson (J&J) asked an order from J&J’s Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it is a bid to stop the litigation involving talc products. The group representing claimants for talc has filed a motion this week requesting to the Third Circuit to consider their case and to send it back an earlier court with instructions for dismissing the bankruptcy. Is there a link between talc and cancer. The committee also requested that the halted tort litigation against J&J should be permitted to continue.
LTL has filed for Chapter 11 protection once again after its bankruptcy filing was rejected in the Third Circuit earlier this year and offered a $8.9 billion settlement. The committee argues that the recent ruling which allowed the second Chapter 11 to continue, while also halting trials against J&J, warrants an immediate Third Circuit review. The US Trustee also asked that be the New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s global vice president of litigation, Erik Haas, was quoted by Bloomberg saying that J&J plans to file a reply in the appeals court saying that the filing is a “desperate and legally insufficient move” by a few of law firms who have competing financial interests.
May 1st 2023 Update: A question people keep asking is how plaintiffs and their attorneys turn down $8.9 billion. Of course, it’s an enormous amount of money. There are a lot of victims. Is there a link between talc and cancer. They are a great claims for plaintiffs. We were reminded of this recently in two talc trials which have resulted in huge verdicts for the plaintiffs. In February, a talcum powder mesothelioma trial in Oregon resulted in an award that was $18.1 million. A month later, another mesothelioma talc case was brought to hearing on the other side of South Carolina and resulted in an award of $29 million in favor of plaintiff. In both instances, the defendant was Whittaker, Clark & Daniels Inc. one of the most prominent suppliers of talc within the U.S.
April 30th 2023 Update: When J&J initially tried to take the lawsuit over talcum powder into bankruptcy, they came with an offer to put aside $2 billion for settlements. It was a ridiculously small amount. All of the talc plaintiffs believed in it. This time, however, J&J has increased the offer to $8.9 If the talc plaintiffs will allow a bankruptcy settlement and they have the support of a large segment of the talc plaintiffs as well as their lawyers. Is there a link between talc and cancer. But 75% of the talc plaintiffs, which is required to approve bankruptcy plans It’s a long and difficult process since there are so many lawyers with massive inventories of baby powder lawsuits that are opposed to the settlement.

What are the solutions to the impasse? More billions.
April 25 2023 Update Talc cancer claimants have requested a judge to dismiss their Chapter 11 case filed by LTL Management LLC, a ridiculously made-up Johnson & Johnson subsidiary, insisting that the company is not financially strained. LTL has filed for Chapter 11 to settle tens of thousands of claims that J&J’s baby products caused cancer. Is there a link between talc and cancer. The 3rd Circuit dismissed its first Chapter 11 case in January and said that LTL was not eligible for bankruptcy relief since it was unable to demonstrate financial trouble.

The claimants argue that LTL’s third Chapter 11 case is an abuse of the bankruptcy system and that it is being pursued in bad good faith. J&J claims the bankruptcy settlement receives “significant backing” from firms representing an estimated 60,000 plaintiffs. It is fair to say plaintiffs’ lawyers and the victims are split over this $8.9 billion amount of settlement offered.

April 21st, 2023 Update: A bankruptcy judge decided the company Johnson & Johnson must face new lawsuits claiming that the company sold tainted baby powder causing cancer. Although the trials for Talc lawsuits are suspended for at least 60 calendar days but new lawsuits can be filed and lawyers can begin preparing their cases. Is there a link between talc and cancer. Judges expressed doubt about J&J’s absurd attempt to revive its strategy by filing another bankruptcy case.

April 13 2023 Update: The major announcement is an $8.9 billion over 25 years settlement offer. Lawyers representing cancer victims within MDL class action MDL collective action pledged to challenge the settlement the talc claimants. Why? They argue that it’s not enough money for 70 000 cancer patients. Is there a link between talc and cancer. They argue that J&J could negotiate a greater settlement or settle individual claims if the latest bankruptcy is dismissed.

But there is another lawyer group that isn’t part of the leadership group in that class action. These lawyers have amassed hundreds of thousands of cases. The group is seeking to settle today for what is believed to be lower than what the victims should be paid. The argument they make is two-fold. The first is that they claim the settlement – about 100,000 dollars per plaintiff is fair.

This argument isn’t easy to present. However, their second argument has more teeth: victims can no longer wait and want to get their money right now.

April 12 2023 Update: Many are asking how J&J can file for bankruptcy again. The answer is complex and complicated. Let’s try to clarify it clearly.
Johnson & Johnson asserts that bankruptcy is the only option to settle both present and future lawsuits involving talc conclusively. Also, it believes it can pay less if there is a bankruptcy element that creates pressure for a settlement. Is there a link between talc and cancer. Going back to hundreds of years of American time, the business believes that bankruptcy is beneficial to everyone by dispersing settlement payments more evenly and effectively than trial courts, which are where litigants get significant awards while others receive nothing.

The gist of this 3rd Circuit decision was this is not a case – an enterprise that is profitable, forming an affiliate to accept the legal liability and declare bankruptcy Congress considered when it was drafting the Bankruptcy Code. However, it also stated the company was in financial trouble because J&J assured it of unlimited funding.
Thus, J&J decided to go with the unlimited funding aspect of the deal and did not promise that it would provide unlimited funds for the litigation. The company claims that new financing agreements with its subsidiary address appeals court’s concerns, while offering funds to pay claims. As if providing victims with less money would solve the overall issue.

Attorneys representing cancer victims who do not agree with the agreement counter the agreement with what is countering legal nonsense legal nonsense: J&J fraudulently transferred $50 billion of assets from LTL Management to circumvent the appeals court’s previous ruling. Hyperbole is not exempt attorneys representing the victims claim it the biggest “fraudulent transfer ever in United States history.”

Despite the legal jargon, J&J does not really believe this bankruptcy will be able to last. It is however a method to try and push the $8.9 billion settlement, and to keep pressure on plaintiffs.

April 10 2023 update: Bloomberg provides an insightful piece on a law that has been passed in New Jersey that is shedding new light on litigation funding in the baby powder suit for class actions. Funders of litigation Virage Capital Management and TRGP Capital invested in hundreds of claims in the case of Johnson & Johnson (J&J) regarding talc products, in exchange in exchange for a portion of settlements. J&J has now offered to pay $8.9 billion to settle any lawsuits.

The involvement of funders is public information due to a New Jersey court rule requiring the release of certain details regarding outside funding backers. This rule is intended to address the rising calls for the regulation of litigation funders. J&J has to deal with more than 60,000 lawsuits when you include state and federal infant powder litigation. Third-party funding for mass tort lawsuits has pros and cons. There is no doubt that we are witnessing how third-party funding can level the playing field between individuals and big corporations in court.

April 4 2023 Update: It is interesting to watch the worm turning in this litigation. J&J was hit again this week when they were denied by the Third Circuit denied J&J’s request to extend the automatic stay during the time that J&J appeals an order granting bankruptcy at the U.S. Supreme Court. It has halted thousands of talcum cases and stopped the filing of new lawsuits ever since J&J initiated the controversial effort to spin the talc liability into a bankrupt subsidiary over one year ago. Is there a link between talc and cancer. After it was decided that the 3rd Circuit ruled that this bankruptcy was not valid a few months ago, the stay was revoked. J&J had hoped to have it continue in the meantime of its SCOTUS appeal. But, no.
April 1st, 2023 Update Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. There is a chance that of the Supreme Court is willing even to take up the appeal? Low.
March 16th, 2023 Update: with the bankruptcy stay in effect, the first new cases were filed and incorporated into the talcum powder class action MDL in the space of a year. Seven new talc-related lawsuits were added to the MDL in the past month which brings the total number of cases pending to 37,522.

February 25 2023 Update This morning, a Congressmen from Tennessee is now demanding that The U.S. Government Accountability Office (GAO) initiate an investigation to determine how much J&J talc products have cost the government over the decades.
A recent email to the GAO, Rep. Steven Cohen (D-Ten.) claimed that J&J of failing to recognize the dangers of its talc product for decades while tax dollars were spent treating those injured by exposure to the chemicals. This lawsuit comes a few weeks after J&J’s significant loss in the 3rd Circuit Court of Appeals.

Is there a link between talc and cancer. J&J has to begin making reasonable settlements to victims, in order to put all of this behind. This is a blemish on one of the most prestigious businesses.

February 14 , 2023 Update: At a hearing today at the hearing in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention following the third U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
