J&J subsidiaries LTL Management filed a bankruptcy plan in New Jersey late on Monday that outlines how the firm intends to pay different types of cancer victims as part of a bankruptcy settlement. It’s trying for an additional time to conclude more than 38,000 lawsuits in bankruptcy and stop new cases from coming forward in the near future.

In the last week, an opposition group, which is known as”The Official Committee of Talc Claimants, urged the bankruptcy court to disqualify the petition by argument that LTL is not a factor in financial distress.
“The filing is an unjust and legally flawed attempt by a small number of law firms to block claimants from voting on the resolution, which that the overwhelming majority of claimants favor,” J&J’s litigation chief Erik Haas, said in an announcement. April 13 2023 Update: The big update is about the $8.9 billion over the next 25 years of settlement. Lawyers representing cancer patients within the MDL Class Action have pledged to fight the settlement along with Talc claimants. Why? They feel it’s not enough for 70 000 cancer patients. But there’s a separate group of lawyers that is not part of the top leadership in the class action. These lawyers have amassed the equivalent of tens of thousands of lawsuits. The group is seeking to settle now for what is believed to be far less than what these victims deserve. Their argument appears to be two-fold. They argue that the settlement of around the equivalent of $100,000 per plaintiff – is fair.
That is a hard argument to make. But their second argument has more teeth: victims can be no longer patient and demand the money immediately.
April 12 2023 Update: Many are asking how J&J can go through bankruptcy again. The answer is complicated and complicated. Let’s try to clarify it in simple terms.
Johnson & Johnson asserts that bankruptcy is the only means to settle both present and future talc lawsuits conclusively. Attorneys representing cancer victims who oppose the deal counter this argument by saying that it is countering legal nonsense with legal nonsense: J&J fraudulently transferred $50 billion of assets away from LTL Management to circumvent the appeals court’s previous ruling. Hyperbole did not go unnoticed: victims’ lawyers call it the largest “fraudulent transfer of assets in United States history.”
Despite the legal jargon, J&J does not really think this bankruptcy will survive. But it’s a way of trying to push this $8.9 billion settlement and keep pressure on plaintiffs.
April 10 2023 update: Bloomberg has an interesting report on a brand new law within New Jersey that is shedding new light on the funding of litigation in the baby powder Class action suit. Litigation funders Virage Capital Management and TRGP Capital invested in hundreds of lawsuits against Johnson & Johnson (J&J) regarding talc products, in exchange for a portion of any profits. J&J has now offered an offer of $8.9 billion in settlements for all lawsuits.
The involvement of the funders is public information because of the New Jersey court rule requiring the release of certain details about funders outside the state.
