It’s difficult to envision an eventuality where J&J can get the settlements of baby powder through given these numbers. While J&J’s $8.5 billion offer seems like a huge sum at first, it does not appear appealing after you calculate the figures. This is the answer to settle these claims with J&J. A baby powder settlement could be completed. Las vegas talcum powder lawyer. But it will require more money – billions of dollars – of Johnson & Johnson.

May 3 2023 Update The group of cancer victims who are suing Johnson & Johnson (J&J) asked that J&J’s Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it is an attempt to derail the litigation involving talc products. The group representing the claimants filed a motion on Tuesday requesting for the Third Circuit to consider their appeal and return the case before a court of lower jurisdiction, with instructions for dismissing the bankruptcy. Las vegas talcum powder lawyer. They also asked that the halted tort litigation against J&J should be permitted to continue.
LTL filed for Chapter 11 protection once again following its bankruptcy filing that was denied by the Third Circuit earlier this year which offered an $8.9 billion deal. The committee argues that the recent decision allowing LTL’s second Chapter 11 to continue, while also halting trials against J&J and J&J, requires urgent Third Circuit review. The US Trustee has also requested it be requested that the New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s vice president for global litigation Erik Haas, was quoted by Bloomberg as saying that J&J intends to file a formal response in the appeals court, saying that the filing is an “desperate and legally flawed plan” by a handful of law firms that have competing financial interests.
May 1st 2023 Update: A most frequently asked question is how plaintiffs and their attorneys turn down $8.9 billion. That’s of course an enormous amount of money. However, there are lots of victims. Las vegas talcum powder lawyer. These are an excellent claims for plaintiffs. We were reminded recently in two talc trials which resulted in big verdicts for plaintiffs. In February the mesothelioma case involving talcum powder trial in Oregon resulted in an award worth $18.1 million. In the same month, a different mesothelioma talc case was brought to trial in South Carolina and resulted in a verdict of $29 million to the plaintiff. It was the same defendant as in these cases: Whittaker, Clark & Daniels Inc. which is one of the top suppliers of talc within the U.S.
April 30th 2023 Update: In the year 2023, when J&J first attempted to drag the talcum powder lawsuit into bankruptcy, they came with an offer to reserve $2 billion to settle the case. This was an absurdly low amount. The talc plaintiffs had not agreed with it. However, this time, J&J has increased the offer to $8.9 if the talc plaintiffs agree to a bankruptcy settlement and they also have the backing of a significant part of the talc-related plaintiffs and their attorneys. Las vegas talcum powder lawyer. However, 75% of talc plaintiffs, which is required to approve bankruptcy plans It’s a long and difficult process due to the sheer number of lawyers with huge stocks of baby powder lawsuits that are opposed towards the agreement.
What can be done to end the impasse? More billions.
April 25, 2023 Update: Talc plaintiffs have asked a judge to reject their Chapter 11 case filed by LTL Management LLC, a absurdly-made-up Johnson & Johnson subsidiary, which claims that the business is not financially strained. LTL requested Chapter 11 to settle tens of thousands of claims that J&J’s baby-powders caused cancer. Las vegas talcum powder lawyer. In the end, however, the 3rd Circuit dismissed its first Chapter 11 case in January, saying LTL was not a candidate for bankruptcy relief since it was unable to demonstrate financial distress.
The claimants argue that the 2nd Chapter 11 case is an abuse of the bankruptcy system, and that it is being pursued in bad faith. J&J claims the bankruptcy settlement has “significant support” from companies representing about 60,000 potential claimants. It’s fair to say plaintiffs’ lawyers and victims ‘ lawyers are divided on this $8.9 billion settlement offer.
April 21st, 2023 Update: A bankruptcy judge ruled in favor of Johnson & Johnson must face new lawsuits alleging that the company sold tainted baby powder causing cancer. While trials in Talc lawsuits are suspended for a minimum of 60 days, new lawsuits can be filed, and lawyers can begin preparing their cases. Las vegas talcum powder lawyer. The judge expressed skepticism over J&J’s ridiculous effort to revive its strategy with the second bankruptcy case.
April 13 2023 Update: The big announcement is an $8.9 billion over the next 25 years of settlement. Lawyers representing cancer patients who are part of the MDL Class Action have promised to fight the settlement with talc claimants. Why? They argue that it’s not enough money for 70,000 victims who have cancer. Las vegas talcum powder lawyer. These lawyers argue that J&J should seek a bigger settlement or even litigate individual claims if the most recent bankruptcy is thrown out.
But there is another lawyer group that isn’t part of the top leadership in group action. The lawyers collectively have accumulated hundreds of thousands of cases. They want to settle now for what is believed to be lower than what the victims should be paid. Their argument seems to be twofold. First, they argue that the settlement – about the equivalent of $100,000 per plaintiff – is fair.
That is a hard argument to present. However, their second argument has more substance: the victims will no longer wait and want their money today.
April 12 2023 Update: Some people are wondering if J&J can go through bankruptcy once more. The answer is complex and complicated. But let’s try to explain it simply.
Johnson & Johnson asserts that bankruptcy is the only means to resolve both current and future talc lawsuits conclusively. That is, it believes that it will be less expensive when there is the bankruptcy element which applies pressure to negotiate a settlement. Las vegas talcum powder lawyer. Going back to 400 years of American past, the company claims that bankruptcy benefits everyone by dispersing settlement payments more equitably and effectively than trial courts where some litigants receive significant award while others do not.
The basic tenet of this 3rd Circuit decision was this is not a case – an enterprise that is profitable, forming an affiliate to accept the legal burden and declare bankruptcy, which is what Congress contemplated when drafting the Bankruptcy Code. But it also said that the entity was in financial trouble due to the fact that J&J offered unlimited financing.
So J&J did not hesitate to take advantage of the unlimited funding portion of the deal and didn’t make any promises to offer unlimited funding for cases. J&J claims that its updated financing arrangements with its subsidiary address the appeals court’s concerns while still offering funds to pay claims. As if offering victims less money will solve the overarching problem.
Lawyers representing cancer victims who are against the agreement argue the agreement with what is countering legal nonsense with legal nonsense: J&J fraudulently transferred $50 billion of assets from LTL Management to circumvent the appeals court’s decision. Hyperbole is not exempt attorneys representing the victims claim it the largest “fraudulent move that has occurred in United States history.”
Notwithstanding the legal mumbo jumbo, J&J does not really think this bankruptcy will survive. But it’s a way to try and push the $8.9 billion settlement and keep the pressure on plaintiffs.
April 10 2023 Update Bloomberg provides an insightful article about a new law that has been passed in New Jersey that is shedding new light on the funding of litigation in the plaintiffs in the class action. Litigation funders Virage Capital Management and TRGP Capital invested in hundreds of claims from Johnson & Johnson (J&J) regarding talc products, in exchange for a portion of any wins. J&J is now offering the payment of $8.9 billion to settle lawsuits.
The funders’ involvement is made public due to a New Jersey court rule requiring the release of certain details about outside funding backers. This rule is intended to tackle the growing demands for regulation of litigation funders. J&J faces over 60,000 claims when you take into account federal and state infant powder litigation. Third-party funding for mass tort lawsuits has pros and cons. There is no doubt that we are seeing how third-party financing can help level the playing field between individuals and big companies in the courtroom.
April 4, 2023 Update: It’s pleasing to see the worm turning in this litigation. J&J has taken another blow this week when they were denied by the Third Circuit denied J&J’s request to keep the automatic stay in place as J&J appeals a bankruptcy ruling before the U.S. Supreme Court. This automatic stay frozen hundreds of cases involving talcum powder and stopped any new lawsuits from getting filed ever since J&J initiated the controversial effort to spin the talc liabilities off into a bankrupt company over one year ago. Las vegas talcum powder lawyer. When it was decided that the 3rd Circuit ruled that this bankruptcy was insufficient only a few months back, the stay was lifted. J&J wanted to see it continued pending hearing the SCOTUS appeal. But, no.
April 1st, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The likelihood that for the Supreme Court is willing even to accept the appeal? Low.
March 16th, 2023 Update: with the bankruptcy stay being officially lifted, the very first new cases have been filed and transferred into the class action involving talcum powder MDL in just over a year. Seven new talc lawsuits have been included in the MDL in the last month and brought the total number of cases pending to 37,522.
February 25 2023 Update: A Congressmen from Tennessee is now requesting that the U.S. Government Accountability Office (GAO) begin an investigation into the amount J&J talc products have cost the government in the decades.
A recent email to the GAO, Rep. Steven Cohen (D-Ten.) has accused J&J of failing to recognize the dangers of its talc products for decades while tax dollars were spent treating those injured by exposure to the products. The suit comes just a few days after J&J’s significant loss in the 3rd Circuit Court of Appeals.
Las vegas talcum powder lawyer. J&J has to begin making reasonable settlement offers for victims in order to put all of this behind. It is a stain on one of the greatest firms.
February 14 2023 Update: At an appearance today in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention following his 3rd U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
