May 1, 2023 Update: One most frequently asked question is how plaintiffs and their lawyers be able to turn off $8.9 billion. That’s of course quite a sum. There are a lot of victims. Organic baby powder talc free. These are an excellent case for plaintiffs. We were reminded recently by two talc-related trials that ended in large verdicts for the plaintiffs. In February the mesothelioma case involving talcum powder trial in Oregon ended in the verdict that was $18.1 million. April 25 2023 update: Talc Cancer victims have asked a judge to disqualify the Chapter 11 case filed by LTL Management LLC, a absurdly fabricated Johnson & Johnson subsidiary, which claims that the business is not financially distressed. LTL filed for Chapter 11 to settle tens of thousands of claims that J&J’s baby-powders caused cancer. Organic baby powder talc free. It was the 3rd Circuit dismissed its first Chapter 11 case in January The court ruled that the company wasn’t eligible for bankruptcy relief since it failed to show financial distress.
The plaintiffs argue that the second Chapter 11 case is an misuse of the bankruptcy system and the case is being handled in bad faith. J&J asserts that the bankruptcy settlement is backed by “significant backing” from the firms that represent about 60,000 potential plaintiffs. It’s safe to say that the plaintiffs’ attorneys and the victims are split over the $8.9 billion offer for settlement.
April 21st, 2023 Update: A bankruptcy judge has decided that Johnson & Johnson must face new lawsuits alleging that it sold a baby powder that contained a chemical that causes cancer. April 13 2023 update: the biggest update is about the $8.9 billion over the next 25 years offer for settlement. Lawyers representing cancer patients who are part of the MDL Class Action have promised to fight the settlement alongside Talc claimants. Why? They think it is not enough for more than 70,000 cancer victims. Organic baby powder talc free. They argue that J&J could negotiate a greater settlement or pursue individuals’ claims if the current bankruptcy is dismissed.
There is a different group of lawyers that is not part of the leadership group in the class action. These lawyers have collectively amassed the equivalent of tens of thousands of lawsuits. The group is seeking to settle now for what is believed to be less than the victims deserve. The argument they make is two-fold. They argue that the settlement of around 100 million dollars on average per plaintiff – is fair.
This is an argument that is difficult to present. The second argument is more force: the victims can not afford to wait any longer and need their money now.
April 12, 2023 Update: People are seeking out how J&J can file for bankruptcy once more. The answer is complicated and convoluted. However, let’s attempt to explain it simply.
Johnson & Johnson asserts that bankruptcy is the only means to address both present and future talc-related lawsuits definitively. That is, it believes it can pay less if there is a bankruptcy component that applies pressure to negotiate a settlement. Organic baby powder talc free. Driving past more than 400 years in American history, the firm asserts that bankruptcy benefits all parties by distributing settlements more fairly and effectively than trial courts where litigants are awarded significant payouts, while others are left with nothing.
The basic tenet in this 3rd Circuit decision was this is not a case of an enterprise that is profitable, forming an affiliate to accept the legal responsibility and declare bankruptcy, which is what Congress thought of when drafting its Bankruptcy Code. But it also said it was not financially crisis due to the fact that J&J assured it of unlimited funding.
Thus, J&J took advantage of the funding unlimited part of the agreement and did not promise to offer unlimited funding for litigation. The company claims that its new financing agreements with its subsidiary will address concerns of the appeals court while supplying funds for claim payments. It’s as if giving victims lower amounts of money would resolve the underlying issue.
Lawyers representing cancer patients who do not agree with the agreement counter this with what you conclude is countering legal nonsense with legal nonsense: J&J fraudulently transferred $50 billion of assets away from LTL Management to circumvent the appeals court’s previous ruling. Hyperbole was not spared by the victims’ lawyers, who call it the largest “fraudulent deal that has occurred in United States history.”
Notwithstanding the legal mumbo jumbo, J&J does not really think this bankruptcy will survive. It is however a method of pushing this $8.9 billion settlement through and maintain the pressure on plaintiffs.
April 10, 2023 Update: Bloomberg has an interesting piece on a law that has been passed within New Jersey that is shedding new light on litigation funding in the baby powder plaintiffs in the class action. Funders for litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits that were brought against Johnson & Johnson (J&J) regarding talc products, in exchange for a portion of any profits. J&J has now offered to pay $8.9 billion to settle all lawsuits.
The funders’ involvement is publicly available because of an New Jersey court rule requiring the release of certain details about funding sources outside of the. The rules aim to address the rising calls for regulation of the litigation funders. J&J is facing more than 60,000 claims when you take into account state and federal child powder-related lawsuits. Third-party funding for mass tort lawsuits has pros and cons. However, there is no doubt that we are witnessing how third-party funding can level the playing field between people as well as large corporations in court.
April 4 2023 Update: It is fun to watch the worm turn in this lawsuit. J&J took another hit this week when it was found that the Third Circuit denied J&J’s request to extend the automatic stay while J&J appeals an order granting bankruptcy to the U.S. Supreme Court. This automatic stay frozen thousands of talcum powder cases and prevented new lawsuits from being filed ever since J&J launched the controversial attempt to spin the talc liability into a bankrupt subsidiary over a year back. Organic baby powder talc free. After the 3rd Circuit ruled that this bankruptcy was invalid a few months ago, the stay was removed. J&J had hoped to have it remain in effect until its SCOTUS appeal. However, the answer was no.
April 1, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. There is a chance that the Supreme Court is willing even to take up the appeal? Low.
March 16th 2023 Update: with the bankruptcy stay officially lifted, the first new cases have been filed and transferred into the talcum powder class action MDL within a year. Seven new talc lawsuits have been added to the MDL in the past month increasing the number of cases that are pending to 37,522.
February 25 2023 Update The following information is available: A Congressmen from Tennessee is now requesting that authorities from the U.S. Government Accountability Office (GAO) start an investigation to determine how much J&J talc products have cost the government over the decades.
in a letter to the GAO, Rep. Steven Cohen (D-Ten.) accused J&J of ignoring the dangers of its talc-based products for years while tax dollars were used to treat those who were injured through exposure to the chemicals. This lawsuit comes a few weeks after J&J’s loss to the 3rd Circuit Court of Appeals.
Organic baby powder talc free. J&J should begin to make reasonable settlement offers to victims to to put all of this behind it. This is a disgrace to one of the most prestigious companies.
