Johnson & Johnson asserts that bankruptcy is the only means to address both present and future lawsuits involving talc conclusively. It believes it can pay less if there is a bankruptcy component that applies pressure to settle. Talc causes cervical cancer. Going back to the 400-year span of American history, the firm argues that bankruptcy benefits all parties because it distributes settlements more equally and effectively than trial courts, where litigants are awarded significant awards while others receive nothing.

Attorneys representing cancer patients who do not agree with the agreement counter the agreement with what is countering legal nonsense legal absurdity: J&J fraudulently transferred $50 billion in assets to LTL Management to circumvent the appeals court’s previous ruling. The hyperbole wasn’t spared by the victims’ lawyers, who call it the most significant “fraudulent transaction that has occurred in United States history.”

Despite the legal jargon, J&J does not really believe this bankruptcy will be able to last. It is however a method to try and push the $8.9 billion settlement to keep the pressure on plaintiffs.
